2003 | Remedies for victims of violations of international humanitarian law: the reports of two expert meetings organized by the universtity of Amsterdam, the Netherlands

The first expert meeting (May 2003) discussed the extent to which existing mechanisms can provide victims of violations of international humanitarian law with a remedy and provide reparation. The experts, Professors F. Kalshoven, L. Zegveld, B. Ramcharan, N. Wühler and Judge F. Pocar, addressed questions on the determination of violations of international humanitarian law, the right of individuals to initiate proceedings, procedures to grant victims a role to participate in proceedings, the possibility for individuals to claim reparations and whether outcomes are legally binding and enforceable. The second meeting (October 2003) examined different options for filling gaps in existing procedures and developing new procedures. Two position papers were presented: the first, “Potentials of existing mechanisms for victims of violations of international humanitarian law” by Dr. Avril McDonald and the second, “Towards new mechanisms for victims of violations of international humanitarian law” by Professor Menno Kamminga.
