This paper welcomes the International Criminal Court Appeals Chamber’s decision to authorize the opening of an investigation in relation to the conflict in Afghanistan and deems the Court’s involvement essential to offer justice to Afghan victims. The author contends that none of the parties to the conflict in Afghanistan have demonstrate a capacity or willingness to prosecute those responsible for alleged war crimes and potential crimes against humanity. Against this background, she views with skepticism Afghanistan’s request for deferral and encourages the Afghan government as well as its international partners to step up and support efforts to ensure accountability for serious crimes at international and national level.
